Lateral Plains Pty Ltd Australia Pty Ltd, ABN 19 604 344 064, (known herein as Lateral Plains), acknowledges and respects the significance and importance of protecting and maintaining the privacy of all information provided to us by our clients and users. In the process of providing our services, we do have to collect some personal information in order to provide an efficient online service, but also in order to interact and communicate with them at appropriate times during the provision of our services.
Lateral Plains obtains personally identifiable information only if we believe the information is relevant to our relationship with a client or to assist us in creating a relationship with a user. We obtain personally identifiable information about clients or users, directly from that client or user whenever possible, primarily in the course of providing them with products, information and services. If at any time Lateral Plains obtains personally identifiable information from third-party sources, we will only use reliable and legitimate referral sources.
Our systems make a record of your visit and logs the following information for statistical purposes - the user's server address, the user's top level domain name (eg. .com, .gov, .au, .uk etc.), the date and time of the visit to the site, the pages accessed and documents downloaded, the previous site visited and the type of browser used. No attempt will be made to identify users or their browsing or email activities except, in the unlikely event of an investigation, where a law enforcement agency may exercise a warrant to inspect the service provider's logs.
In the case of our email systems, email logs are recorded, which include the email addresses of recipients and senders, originating and receiving servers, time of transmission and receipt and the success or otherwise of receipt/delivery). This information is recorded to assist in maintenance and troubleshooting of email accounts and to track any attempted unauthorised use of our email systems, such as spamming and malware transmission.
We do not provide any information to anyone in respect of the email logs except in the case of where we are legally compelled to do so and (where an email user is an an employee of a client that is a company, where the authorised company representative has requested such information for maintenance or troubleshooting purposes with regard to the services we provide.
USE OF PERSONAL INFORMATION
Lateral Plains uses personally identifiable information to respond to our clients or users and to make decisions about the products and/or services. Apart from the above, Lateral Plains does not collect or pass on any of this information to any other party.
Lateral Plains may be required to disclose personally identifiable information by law or compulsory legal process.
Under no circumstances will we sell your individual personal information to any third party, however in some circumstances, Data which DOES NOT identify any individual user, may be given or sold in aggregate, to one of our clients.
Lateral Plains uses reasonable administrative, technical, personnel, and physical measures to safeguard personally identifiable information in its possession against loss, theft, and unauthorized use, disclosure or modification. Any information that we store about you is protected from unauthorised access through the use of firewalls, secure passwords and sign in processes.
ACCESS, CORRECTION AND DELETION
Whenever possible, Lateral Plains will permit clients and users, the right to see the personally identifiable information that Lateral Plains has collected from them, in order for them to correct any information that may be incorrect and / or to instruct it to delete the information from its files.

Lateral Plains provides online and Internet based services (Server System and/or associated connectivity) for use by its clients. In order for clients to be able to use our systems or associated connectivity provided to clients for access by their own servers, they have agreed to comply with this Acceptable Usage Policy (AUP) as part of their agreement with Lateral Plains for their use of the online and Internet based services and such connectivity. Lateral Plains may vary this AUP by written notice to clients from time to time. A reference in this AUP to a client includes its officers, employees, members, affiliates, participants, agents and contractors.
Lateral Plains reserves the right to suspend or withdraw any client's access to the online and Internet based services and/or associated connectivity where it believes that the group has breached this AUP or the online and Internet based services and/or associated connectivity is being abused. A client who is permitted to use the online and Internet based services and/or associated connectivity is solely and fully responsible for all content, data and other information which the group stores on, or transmits, using the online and Internet based services and/or associated connectivity. A client breaches this AUP and its agreement with Lateral Plains when that client uses the online and Internet based services and/or associated connectivity to engage in any of the following prohibited activities:
The use of the Server System and/or associated connectivity to store or transmit content, data or other information which is obscene, offensive, pornographic or unsuitable for persons under 18 years of age is prohibited. This includes sites that may infer sexual content or links to adult content elsewhere. Lateral Plains will be the sole arbiter in determining violations of this provision.
Defamatory, Abusive and Discriminatory Material
Using the online and Internet based services and/or associated connectivity to store or transmit content, data or other information which is defamatory, harassing, abusive, threatening, upsetting, discriminatory, vilifying or denigrating.
Forging of Headers
Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.
Any unsolicited commercial e-mail is considered spamming if it breaches the Spam Act 2003 (C'th). Spamming not only affects Internet users' attitudes toward Lateral Plains but also disrupts the services provided to others who use the online and Internet based services and/or associated connectivity and consumes excessive bandwidth resources. Lateral Plains may, at its discretion, suspend or withdraw a client’s access to the online and Internet based services and/or associated connectivity where it believes that the client has engaged in spamming.
Intellectual Property Violations
Infringing or misappropriating the intellectual property rights of others, including copyrights (e.g. software piracy), trademarks, trade secrets, patents, designs, and semiconductor and circuit layout rights held by individuals, corporations, or other entities. Also, violating privacy or other personal rights of others. Lateral Plains will remove or block access to content stored on our systems and/or in relation with associated connectivity upon receipt of a proper notice of copyright or other intellectual property right infringement. It is also Lateral Plains's policy to withdraw a client's access to the online and Internet based services and/or associated connectivity where the client has committed repeat violations of copyright or other intellectual property laws, or repeat violations of the privacy or other personal rights of others.
Illegal or Unauthorized Access to Other Computers or Networks
Accessing illegally or without authorization computers, accounts, or networks belonging to another person, or attempting to penetrate security measures of another person's system (often known as "cracking"). Also, any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).
Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities
Distributing information regarding the creation of, and the sending of, Internet viruses, worms, Trojan horses, malicious programs, pinging, flooding, mailbombing, or denial of service attacks. Also, activities that disrupt the use of, or interfere with the ability of others to effectively use, the Server System and/or associated connectivity.
Illegal or Unlawful Conduct
Any conduct relating to, or connected with, the use of the Server System and/or associated connectivity by a community group that is unlawful or illegal or which Lateral Plains considers to be potentially unlawful or illegal.
Facilitating a Violation of this Acceptable Use Policy
Advertising, transmitting, or otherwise making available any software, program, product or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mailbombing, denial of service attacks, and piracy of software.
Engaging in activities, whether lawful or unlawful, that Lateral Plains determines to be harmful or contrary to the interests of it clients and its operations and/or to the broader community of Internet users.
